The Sir Francis Burt Oration provides a forum for distinguished members of the legal profession to reflect on the principles that defined Sir Francis Burt’s remarkable legacy: intellectual excellence, integrity, public service, and an enduring commitment to the rule of law. This year’s Oration, delivered by The Honourable Justice James Edelman AC, was a fitting continuation of that tradition.
Clinton Russell SC, as Chair of Francis Burt Chambers, introduced Justice Edelman to an audience that included the Honourable Chief Justice of WA, Mr Peter Quinlan SC, judges and registrars (of the Supreme Court of WA, the Federal Court of Australia, the District Court of WA, the Family Court of WA, and the Coroner’s Court of WA), the former Governor of WA, Malcolm McCusker AC CVO KC, relatives of the late Sir Francis Burt, Ms Janine Milton and Ms Eve Burt, and members of the profession. Clinton spoke of his Honour’s distinguished career, which spans judicial service, academia, and legal scholarship. His Honour’s judgments and extra-curial writings are well-known for their influence on legal thought, both nationally and internationally.
In his address, “How Judges Decide Cases”, Justice Edelman explored the evolution of judicial decision-making from the perspective of an ultimate appellate court. Beginning with the judicial techniques of one of the most acclaimed judges in the Anglo-Australian legal tradition 150 years ago, he examined both the changes and enduring principles that continue to shape judicial reasoning today.
The Oration showcased Justice Edelman’s characteristic scholarship, insight, and clarity of thought, offering attendees a thought-provoking reflection on the nature of judging and the enduring importance of principled legal reasoning in maintaining public confidence in the rule of law. The drinks and canapes afterwards was a lovely opportunity for attendees to reflect on his Honour’s address, and enjoy the company of friends and colleagues.
