Before a witness ever enters a courtroom, that witness will have had at least one proofing session with their counsel.
When proofing a witness, how do you distinguish between recollection and recent invention? To what extent should a witness be probed on inconsistencies with the contemporaneous documentary record? What ethical issues do you need to be aware of and how do you ensure that you are on the right side of the ethical line?
Francis Burt Chambers has prepared an interactive session using a hypothetical dispute – involving a young musician that appears to have done a deal with the devil – to explore these, as well as other important, trial skills. This session will be held before the annual Bali Piddington Conference and will not require preparation by attendees.
