The session explored the way in which courts determine issues relating to how corporations think and why corporations have acted in certain ways, from its anthropomorphic origins all the way to the emerging doctrine of systems intentionality. The audience was left with some practical takeaways as to the difference between inferring intent through the aggregation of knowledge and inferring intent from evidence of systems or patterns of behaviour. There was also recognition of the fact that one cannot present on a topic in 2025 without addressing the artificially intelligent elephant in the room: how will AI change the way in which the law regards how corporations think?
